Gender Selection Australia

Last reviewed 2026-10-27

Non-medical sex selection is prohibited in Australia. The NHMRC's ethical guidelines on assisted reproductive technology prohibit it at paragraph 8.14.1, and those guidelines bind accredited clinics through the accreditation system. Victoria, Western Australia and South Australia also legislate on it directly. Medical sex selection, to avoid a serious sex-linked condition, is permitted.

A prohibition that works through accreditation

Australia's arrangement is unusual and worth understanding, because it explains why the answer feels less absolute than Canada's. The core instrument is a set of ethical guidelines rather than a criminal statute. They bind clinics because accreditation depends on compliance, and an unaccredited clinic cannot practise. The effect on you is the same — no Australian clinic will do it — but it sits in a different part of the legal system, and in three states it is reinforced by legislation.

The NHMRC reviewed exactly this question when it revised the guidelines in 2017. The public consultation reportedly produced a majority of submissions favouring a permissive approach, and the prohibition was maintained regardless, pending further debate. Anyone who assumes the Australian position is settled should know that its own regulator does not treat it that way.

What Australian patients do

The United States is the principal destination — lawful at federal level, no accreditation barrier, and the longest-standing programmes. It is also the most expensive route in the world for this treatment, with published estimates for a cycle including embryo screening running to tens of thousands of US dollars before medication. Distance adds two long-haul trips, because the embryo transfer happens in a separate cycle from collection.

That two-trip structure is the detail Australian patients most often cost incorrectly. Stimulation and collection are one visit; the frozen transfer is another, weeks later. Some patients arrange monitoring at home and travel only for the procedures — ask whether the clinic accepts outside monitoring before you assume it.

Ask about travelling
Is gender selection legal in Australia?

Not for non-medical reasons. The NHMRC's 2017 ethical guidelines on assisted reproductive technology prohibit it at paragraph 8.14.1, and Victoria, Western Australia and South Australia legislate on it separately. Medical sex selection to avoid a sex-linked condition is permitted.

Can Australians travel overseas for gender selection?

The prohibition operates on Australian clinics through accreditation and state law. Patients commonly travel, principally to the United States. Take your own legal advice if the question matters to your decision.

Why was sex selection not legalised in the 2017 NHMRC review?

The review considered the question and maintained the existing prohibition pending further public debate, despite consultation submissions reportedly favouring a more permissive approach.
